Terms of Service

These Terms of Service (hereinafter referred to as these "Terms") shall apply to the service provided by WAKOH Co., Ltd. on this website (hereinafter referred to as the "Service"). Users (hereinafter referred to as "customers") who use the Service without member registration are supposed to use the Service in accordance with these Terms. If customers agree to these Terms, the content hereof shall be the content of the agreement between customers and us.

 

Article 1 (Application)

These Terms shall apply to all relationships between customers and us relating to the use of the Service.

We may establish some rules and regulations regarding the use of the Service (hereinafter referred to as "individual rules"), in addition to these Terms. These individual rules shall constitute a part of these Terms, regardless of their names.

In the event that any provision of these Terms conflicts with any of the individual rules set forth in the preceding Article, the provisions of the individual rules shall prevail, unless otherwise specified in the individual rules.

 

Article 2 (Use of the Service and Conclusion of Agreement)

Customers may use the Service without member registration. In this case, we will not manage any information such as their usage history. Please note that we will not be able to respond to any inquiries regarding customers' past usage history.

In the case of minor customers, the consent of a person in parental authority is required to use the Service.

A sale and purchase agreement between a customer and us shall be concluded when the customer completes the order process within the Service and we receive the relevant information regarding such an order of purchase. Upon receipt of such information regarding the purchase order sent by the customer, we will send the customer an e-mail for confirmation of the order details.

 

Article 3 (Change or Cancellation of Order)

Once an order has been completed, changes to or cancellation of the order for reasons attributable to the customer will not be accepted.

Orders from areas where delivery is deemed impossible by the shipping company may be canceled even after the sale and purchase agreement has been concluded. In this case, we shall refund the price of the product and delivery fees to the customer.

 

Article 4 (Return and Exchange of Goods)

Returns or exchanges of goods for reasons attributable to the customer will not be accepted.

We will accept exchanges only when the customer receives an item that is different from the ordered goods, or when there is a defect in quality such as damage. Please contact us within seven days of receiving the goods. Please note that we do not accept returns or refunds.

 

Article 5 (Delivery Fees)

Please pay the delivery fees that we specify. Please refer to the Items page for details.

 

Article 6 (Payment Method)

Payment for goods shall be made by the payment method that we specify unless we do not accept the purchase. For details on available credit cards, etc., please refer to the "Payment Method" section in the Specified Commercial Transaction Act page.

 

Article 7 (Shipping of Goods)

The shipping time varies depending on the product ordered. Please check the delivery date on the Items page before placing your order. We are not liable for any deterioration of goods due to delivery delays caused by traffic or weather conditions or delays in receiving the goods from the delivery company.

Ownership of all goods purchased through the Service shall transfer to customers at the time we hand over the goods to the delivery company, regardless of the payment method or delivery method.

 

Article 8 (Prohibition of Resale, etc.)

The purchase of goods on this website for wholesale, retail, resale, etc. to third parties, for sale on auction sites, or for any other commercial purpose is prohibited. In the unlikely event that resale, etc., is recognized, we reserves the right to take necessary measures.

 

Article 9 (Prohibited Acts)

(viii) Acts that collect or accumulate personal information of other customers;

(ix) Acts that use the Service with a wrongful purpose;

(x) Acts that cause disadvantage, damage, or discomfort to other customers of the Service or other third parties;

(xi) Acts that impersonate other customers;

(xii) Acts of advertising, promotion, solicitation, or sales on the Service that are not authorized by us;

(xiii) Acts that purchase goods on this website for the purpose of resale or other profit-making activities;

(xiv) Acts that directly or indirectly provide benefits to anti-social forces in relation to the Service; and

(xv) Any other acts that we deem inappropriate.

 

Article 10 (Suspension of Provision of the Service, etc.)

We may suspend or discontinue all or a part of the Service without prior notice to customers for any of the following reasons:

(i) When we perform maintenance checkups or updating of computer systems related to the Service;

(ii) When provision of the Service becomes difficult due to force majeure events such as earthquakes, lightning, fire, power outages, or other natural disasters;

(iii) When computers, communication lines, etc. are stopped due to an accident; and

(iv) In any other cases where we deem it difficult to provide the Service.

We shall not be liable for any disadvantage or damage incurred by customers or other third parties due to the suspension or interruption of the provision of the Service.

 

Article 11 (Restrictions of Use)

We may restrict customers' use of all or a part of the Service without prior notice in any of the following cases:

(i) When the customer violates any of the provisions of these Terms;

(ii) In the event of default in any debt paymens;

(iii) When the customer does not respond to communications from us for a certain period of time;

(iv) When the customer belongs to anti-social forces or has a relationship with anti-social forces; and

(v) In any other cases where we deem the use of the Service to be inappropriate.

We shall not be liable for any loss or damage incurred by customers as a result of our acts in accordance with this Article.

 

Article 12 (Disclaimer of Warranties and Limitation of Liability)

We do not warrant, expressly or impliedly, that the Service will be free from defects in fact or law (including defects in safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, etc., errors or bugs, infringement of rights, etc.).

We shall not be liable for any loss or damage incurred by customers arising out of or in connection with the Service; provided, however, that this does not apply to damages caused by default or tort due to our negligence.

Even in the case described in the proviso of the preceding paragraph, we shall not be liable for any loss or damage arising from special circumstances (including cases where we or customers foresaw or could have foreseen its occurrence). We will compensate only for actual, ordinary damages up to the amount received from the customer for the transaction that caused such damage.

We shall not be liable for any transactions, communications, or disputes between a customer and other customers or third parties in connection with the Service.

The product images shown on this website may differ slightly from the actual product in terms of color and size due to screen settings and photographic techniques.

 

Article 13 (Change of Service Content, etc.)

We may change the content of the Service or discontinue provision of the Service without prior notice to customers. We shall not be liable for any loss or damage incurred by customers as a result of such changes or discontinuation.

 

Article 14 (Revision of these Terms)

We may change these Terms at any time by posting the revised Terms of Service on this website with an established effective date and making the revised Terms known to customers in advance. In the event that a customer starts using the Service after the change in these Terms, the customer shall be deemed to have agreed to the revised Terms, and the agreement between the customer and us will be changed at the same time.

Copyrights, trademarks, design rights, and other intellectual property rights related to the text, images, designs, etc. posted on this website belong to us or the appropriate owner of such rights. Customers may not reproduce, edit, modify, publish, reprint, distribute, sell, or provide any copyrighted materials, etc. obtained through the use of the Service, unless being authorized by us or the appropriate owner, or unless otherwise permitted under the law.

Article 18 (Prohibition of Assignment of Rights and Obligations)

Customers may not assign or offer as security their position under the agreement or their rights and obligations under these Terms to any third party without our prior written consent.

 

Article 19 (Governing Law and Jurisdiction)

These Terms shall be governed by and construed in accordance with the laws of Japan.

In the event of any dispute regarding the Service, the court having jurisdiction over the location of our head office shall have exclusive jurisdiction.
